Terms of Use

These Terms of Use ("Terms") govern access to and use of the AggHauler platform, driver PWA, and website (the "Services") provided by AggHauler, LLC ("AggHauler," "we," "us"). By creating an account or using the Services, you agree to these Terms.

1. Accounts

You must provide accurate information and are responsible for activity under your account. Keep your password confidential. You must be at least 18 years old and authorized to bind your company.

2. Subscriptions and billing

• Subscriptions are billed monthly or annually in advance through Stripe.
• Free trials, when offered, convert automatically to a paid subscription unless canceled before the trial ends.
• Fees are non-refundable except where required by law. Yearly plans are not prorated on cancellation; access continues through the paid period.
• We may change pricing with at least 30 days' notice for renewals.
• Overages and plan seat limits (e.g., driver caps) are enforced at the application level and require an upgrade to exceed.

3. Acceptable use

You will not:

• Use the Services to violate law or the rights of others.
• Attempt to breach security, access another tenant's data, or reverse-engineer the platform.
• Upload malware or scrape the Services in bulk.
• Use driver location data for unlawful surveillance.

4. Your data

You retain ownership of the data your organization enters. You grant AggHauler a license to host, process, and display that data solely to provide the Services. See our Privacy Policy.

5. Driver safety and Drive Mode

AggHauler provides tools such as Drive Mode audio announcements to reduce driver distraction. Drivers remain solely responsible for safe operation of vehicles and compliance with all traffic laws. AggHauler is not a substitute for attentive driving and is not liable for accidents, injuries, or damages arising from vehicle operation.

6. Third-party services

The Services rely on third parties including Stripe, Google Maps, and email providers. Your use of those services is subject to their terms. We are not responsible for third-party outages or errors.

7. Availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance and unplanned outages may occur.

8. Termination

You may cancel your subscription at any time through the Billing screen. We may suspend or terminate accounts that violate these Terms, fail to pay, or pose a security risk. Upon termination we may delete your data after a reasonable grace period.

9. Disclaimer

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGGHAULER'S TOTAL LIABILITY UNDER THESE TERMS IS LIMITED TO THE FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

11. Indemnification

You will indemnify AggHauler against claims arising from your data, your use of the Services, or your violation of these Terms.

12. Governing law

These Terms are governed by the laws of the state where AggHauler, LLC is organized, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts of that jurisdiction.

13. Changes

We may update these Terms. Material changes will be announced by email or in-app notice. Continued use after the effective date constitutes acceptance.
